These Terms of Service (“Terms”) govern your use of eyegallerybygarenoganni.com (the “Site”) and any purchase you make from Eye Gallery (“we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract to place an order. By ordering, you represent that you meet these requirements.

Account registration

If you create an account, you are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately if you believe your account has been accessed without permission.

Products, pricing, and availability

We work to keep product descriptions, pricing, and availability accurate, but errors happen. Colors and finishes may vary slightly from what appears on your screen. Prices are listed in U.S. dollars and do not include tax or shipping unless stated. We reserve the right to correct errors, change prices, and limit quantities at any time, including after you place an order. If we change the price or cancel an order because of a pricing or availability error, we will contact you and offer a refund or a chance to reconfirm at the corrected price.

Orders and acceptance

Your order is an offer to purchase. We accept it when we ship the product or send an order confirmation. We may decline or cancel any order at our discretion, including for suspected fraud, payment issues, inventory shortfalls, or shipping restrictions.

Payment

Payments are processed by our payment provider, Authorize.Net. You authorize us and our payment provider to charge the payment method you provide for your order total, including tax and shipping. If a payment is declined or reversed, we may cancel the order and seek reimbursement of any associated costs.

Shipping and delivery

Shipping timelines shown at checkout are estimates, not guarantees. Title and risk of loss pass to you when the carrier delivers the product to the address you provided. If a package is lost or damaged in transit, contact us promptly so we can work with the carrier.

Returns and refunds

Our return, exchange, and refund terms are described in our Refund and Returns Policy, which forms part of these Terms. Prescription eyewear and custom orders are generally non-returnable; please read that policy before ordering.

Gift cards

Gift cards are redeemable on the Site and, where offered, in store. Gift cards are non-refundable except where required by law, cannot be redeemed for cash, and expire according to applicable law. Treat a gift card like cash; we are not responsible for lost or stolen cards.

Prescription products

Prescription lenses and contact lenses require a valid, unexpired prescription from a licensed eye-care provider. You are responsible for the accuracy of the prescription details you submit. We may ask for a copy of your prescription and may cancel an order if we cannot verify it. Nothing on the Site is medical advice; if you have questions about your vision, consult your eye-care provider.

Acceptable use

You agree not to use the Site in any way that is unlawful, harmful, deceptive, or that interferes with other users or with the Site’s operation. That includes, but is not limited to, scraping or harvesting data, reverse-engineering the Site, attempting to gain unauthorized access, introducing malware, and using the Site to transmit content that infringes others’ rights.

Intellectual property

All content on the Site, including text, images, logos, product photography, videos, and design, is owned by Eye Gallery or our licensors and is protected by copyright, trademark, and other laws. You may view and use the Site for your personal, non-commercial shopping use. Any other use, including reproduction, modification, distribution, or public display, requires our prior written consent.

User submissions

If you send us ideas, reviews, photos, or other content, you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, and display that content in connection with our business, and you represent that you have the rights to do so. Do not submit content that is unlawful, defamatory, infringing, or that includes sensitive personal information.

Third-party links and services

The Site may link to or integrate third-party services (for example, payment, shipping, or social media). We are not responsible for third-party content or practices; your use of third-party services is subject to their terms.

Disclaimers

The Site and products are provided on an “as is” and “as available” basis, without warranties of any kind except as required by law. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Our total liability for any claim relating to the Site or a product will not exceed the amount you paid us for the product that is the subject of the claim.

Indemnification

You agree to indemnify and hold Eye Gallery harmless from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, misuse of the Site, or violation of any law or third-party right.

Governing law and venue

These Terms are governed by the laws of the State of California, excluding its conflict-of-laws rules. Any dispute that is not resolved informally will be brought in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts.
